Your agreement with Ate Plates
These Terms govern the Ate Plates website and beta app provided by Ate Plates LLC (“Ate Plates,” “we,” “us”). By creating an account, signing in, or using the service, you agree to these Terms. If you do not agree, do not use the service. Our Privacy Policy and Consumer Health Data Privacy Policy explain data handling; agreeing to these Terms does not replace consent required for sensitive data or optional features.
You must be at least 18 and legally able to enter this agreement to participate in the beta. Provide accurate account information, protect your sign-in credentials, and contact hello@ateplates.com about suspected unauthorized access. You are responsible for activity you authorize through your account.
AI, allergies, and food safety
Always verify food suitability before cooking or eating. AI-generated recipes, dish identifications, ingredient lists, substitutions, nutrition estimates, and learned preferences can be inaccurate or incomplete. Entering an allergy or dietary restriction does not guarantee a safe suggestion.
Ate Plates is a meal-planning aid, not a medical service, dietitian, allergen detector, or emergency service. It does not diagnose, treat, cure, or prevent disease or provide individualized medical or clinical nutrition advice. Do not rely on its suggestions or estimates for treatment decisions or management of a medical condition. Consult a qualified professional for those needs.
You must independently check the full recipe, every ingredient and product label, substitutions, preparation methods, and the needs of everyone eating the meal. We cannot verify manufacturing practices, restaurant preparation, hidden allergens, cross-contact, ingredient spoilage, or your cooking environment. A photo cannot establish that food is allergen-free or safe. Follow reliable food-handling guidance and verify safe cooking temperatures and storage. Do not prepare or consume a dish if its suitability is uncertain.
Nutrition and portion estimates, including those exported to Apple Health, are approximations rather than measured intake. Review and correct records as needed. No recipe, recommendation, tag, or illustrative example is a certification that everyone at your table can eat it.
Recipe images and results
Recipe images are illustrative visual references. An image may depict a similar dish rather than the generated recipe and may differ in ingredients, allergens, quantities, technique, presentation, or serving size. Images do not promise a cooking result or establish nutritional content or dietary suitability. Review the written recipe and independently verify safety. Third-party images and source materials remain subject to their owners’ rights; a source link is not an endorsement.
Beta availability and your records
The beta may contain bugs, lose data, produce inconsistent results, or change or end. Features and access may vary, and we do not promise uninterrupted availability or any future feature. Keep your own copies of information you need. Auto-detect can miss meals or identify non-food photos as meals; review automatically created entries. You can disable it in Settings.
Any future paid offering will disclose pricing and applicable payment terms before a purchase. These Terms do not authorize an undisclosed subscription or charge.
Your content and our service
You retain your rights in photos, text, and other content you submit. You grant Ate Plates a nonexclusive, worldwide, royalty-free license to host, copy, process, and display that content, and to permit service providers to do so on our behalf, only as needed to operate and provide the service as described in the privacy policies. This does not grant permission to use your meal photos in public advertising. The license lasts while we lawfully retain content for those purposes and does not override deletion rights.
Only submit content you are entitled to provide. Do not upload another person’s private or health information without appropriate authority. The beta does not support accounts for children. Enter information about the people you cook for, including children in your household, only if you have the authority to share it.
We and our licensors retain rights in the app, software, branding, and other service materials. Subject to these Terms, you may use the service for personal, noncommercial meal planning. AI output may resemble output provided to others; we do not guarantee exclusivity or that every output qualifies for intellectual-property protection. Your use remains subject to applicable third-party rights. You may voluntarily provide feedback that we may use to improve the service; this does not expand our rights to your personal information.
Acceptable use and external services
Do not use the service unlawfully, infringe others’ rights, impersonate others, upload malicious code, bypass access controls, interfere with operation, or extract other users’ information. Do not copy or redistribute the service’s software or content except as permitted by these Terms or law. Nothing prohibits legally protected interoperability, research, or consumer rights.
External shopping, sign-in, app-distribution, and linked content services have their own terms. Instacart and its merchants are responsible for their transactions, prices, availability, fulfillment, and substitutions. Verify purchased products and substitutions yourself. Ate Plates does not guarantee or control third-party goods or services. Applicable Apple distribution terms and any applicable app license also apply; these Terms do not reduce rights Apple’s terms or law give you.
Warranty disclaimer
To the fullest extent permitted by applicable law, the beta and its content are provided “as is” and “as available.” Ate Plates disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement, and does not warrant accuracy, reliability, availability, or that recipes meet dietary requirements. This disclaimer does not exclude any warranty or consumer protection that cannot lawfully be excluded.
Limits of liability
To the fullest extent permitted by law, Ate Plates LLC is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of data, arising from the service. Subject to the exceptions below, our total aggregate liability arising from the service or these Terms will not exceed the greater of US $100 or the amounts you paid Ate Plates for the service in the 12 months before the event giving rise to the claim.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where liability cannot be limited, or any other liability or statutory remedy that applicable law does not allow us to exclude or limit. They apply only to the extent lawful in your jurisdiction. Your nonwaivable consumer and privacy rights remain intact.
Ending use, disputes, and changes
You may stop using the service at any time, delete your account in the app under Settings › Delete Account, or request deletion at hello@ateplates.com. We may suspend or terminate access for material violations, security risks, legal requirements, or discontinuation of the beta, with notice where practicable and legally required. Ending access does not eliminate privacy obligations or rights that accrued before termination. Provisions that by their nature should survive will do so to the extent lawful.
Please contact us about disputes so we can try to resolve them. This does not restrict your right to bring a claim, seek urgent relief, or contact a regulator, or extend a filing deadline. These Terms do not require binding arbitration, waive class actions, or select an exclusive court. Applicable law determines governing law and jurisdiction, including mandatory consumer protections.
We will provide notice of material revisions and state when revised Terms take effect. Where required, we will ask for renewed acceptance. Changes do not retroactively remove accrued rights. If a provision is unenforceable, the remainder continues to the extent permitted by law. Failure to enforce a provision is not a waiver.
